Yet another iPod lawsuit

While Apple's iPod was the best selling gift this Christmas, as well as a strong seller for 2006, it has also faced a slew of lawsuits---some valid, some not.
A consumer group, called Foundation for Taxpayer and Consumer Rights, has sued Apple, claiming that the iPod nano can't take normal use.
The group says the device can become warped to the point where it's impossible to read.
A portion of the complaint reads, "Merely carrying the device in a pocket, a use expressly advertised by Apple, causes cracks, streaks, scratches, and scuffs that make text displayed on the screen difficult to read or illegible."
The suit claims that Apple has been unwilling to replace the damaged devices, and even forces customers to pay US$25 to have them fixed.
The consumer group wants either a free recall of the defective nanos or a full replacement cost for unhappy users.
